1. About these terms
Hidden Hunt is a Mindazzle game, operated by DataWave LTD (“we”, “us”). These terms are an agreement between you and DataWave LTD. By downloading, opening or playing Hidden Hunt, you agree to them. If you don’t agree, please don’t use the game.
How we handle your data is explained in our Privacy Policy.
2. Playing the game
We give you a personal, non-exclusive, non-transferable, revocable licence to install and play Hidden Hunt for your own non-commercial entertainment, on devices you own or control, in line with these terms and the rules of the store you got it from.
Hidden Hunt is suitable for all ages. If you are under the age of adulthood where you live, please make sure a parent or guardian agrees to these terms, especially before making a purchase.
3. Your progress
There is no account. Your progress is kept on your device and backed up under a random save code (shown in the game’s Settings), which lets you continue on another device. Keep the code private: anyone who has it can load your progress. We try to keep saves safe, but we can’t guarantee progress is never lost, for example if you uninstall the app or clear your browser’s data without noting your code.
4. Purchases and virtual items
- The apps offer optional purchases: hint packs, Remove Ads and a one-time starter bundle. The web version has no purchases.
- Purchases are made through Google Play or the Apple App Store and are also governed by their terms. Prices are shown in the store before you pay and may change from time to time.
- Hints and other in-game items are a licence to use content in the game. They have no cash value, can’t be exchanged for money or transferred to anyone else, and are used up when you use them.
- Refunds are handled by the store you bought from, under its refund policy. Nothing in these terms limits any right to a refund you have by law.
- If something you bought doesn’t arrive, use Settings → Restore purchases, or contact us.
5. Ads
The free apps show ads, provided by Google AdMob. Some ads are optional: you can choose to watch one in exchange for free hints. Ads are shown according to the choices you make in the consent prompt (see the Privacy Policy). We are not responsible for the content of third-party ads or for the products they promote.
6. Fair play
Please don’t:
- copy, modify, sell, rent or redistribute the game or its content;
- reverse engineer or tamper with the game, except where the law expressly allows it;
- use cheats, bots or exploits, or try to get items without paying for them;
- attack, overload or interfere with our servers, or access them other than through the game;
- use the game in any unlawful way.
If you break these rules we may suspend or end your access to online features.
7. Our content
The game, including its artwork, scenes, puzzles, music, sounds, text, software and the Hidden Hunt and Mindazzle names and logos, belongs to DataWave LTD or its licensors and is protected by copyright and other laws. Apart from the licence in section 2, these terms give you no rights in it.
8. Changes to the game
We keep improving Hidden Hunt, so we may add, change or remove levels, features and items, and we may need to suspend or stop online services or the game itself. Where a change significantly affects something you paid for, we will try to tell you in advance.
9. No warranty
The game is provided “as is” and “as available”. To the extent the law allows, we make no promises that it will always be available, uninterrupted or error-free. Your legal rights as a consumer are not affected.
10. Our liability
To the extent the law allows, DataWave LTD is not liable for indirect or consequential loss, or for loss of data, profits or opportunity, arising from your use of the game, and our total liability to you is limited to the amount you paid us for the game in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, such as for death or personal injury caused by negligence, or for fraud.
11. Ending
You can stop playing at any time by uninstalling the app or leaving the website. These terms end if you or we stop them; sections 4 (as to completed purchases), 7, 9, 10 and 13 continue to apply.
12. Apple devices
If you got Hidden Hunt from the Apple App Store:
- these terms are between you and DataWave LTD only, not Apple, and DataWave LTD, not Apple, is responsible for the game and its content;
- your licence is limited to using the game on Apple-branded products you own or control, as permitted by the App Store’s Usage Rules;
- Apple has no obligation to provide maintenance or support for the game;
- if the game fails to meet an applicable warranty, you may notify Apple, which will refund the purchase price (if any); to the extent the law allows, Apple has no other warranty obligation for the game;
- DataWave LTD, not Apple, is responsible for addressing any claims relating to the game, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection claims, and claims that it infringes someone else’s intellectual property;
- you confirm that you are not in a country subject to a U.S. Government embargo or designated as “terrorist supporting”, and are not on a U.S. Government list of prohibited or restricted parties;
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
13. Law
These terms are governed by the laws of the country where DataWave LTD is registered. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring claims in your local courts.
14. Changes to these terms
We may update these terms, for example when we add features or the law changes. We’ll post the new version here with a new date, and tell you in the game about significant changes. If you keep playing after a change takes effect, the new terms apply.
